1. Eligibility
You must be at least 18 years old (or the legal age for gambling in your jurisdiction, whichever is higher) to use MetricKick. By using the service you confirm that you meet this requirement and that using it does not break any law that applies to you.
MetricKick is provided for informational purposes only and is not available where its use would be unlawful. You are responsible for ensuring that betting is legal in your location.
2. The service
MetricKick provides model probabilities, fair (no-vig) odds, expected-value estimates, and related analytical tools for football matches. All outputs are informational. They are not betting tips, financial advice, or any form of guarantee.
We may change, suspend, or discontinue any part of the service at any time. We work to keep data accurate and current but do not warrant that it is error-free or continuously available.
3. Accounts
You are responsible for keeping your login credentials secure and for all activity on your account. Tell us promptly if you suspect unauthorised use. You may not share, resell, or scrape the service except as expressly permitted by your plan.
4. Subscriptions, billing & refunds
Paid plans renew automatically each billing period until cancelled. You can cancel at any time from your billing portal; access continues until the end of the period already paid for.
First purchases are covered by a 7-day refund window: if you are not satisfied, contact support@metrickick.com within 7 days of your first payment for a full refund of that payment. Renewals and subsequent payments are non-refundable except where required by law.
5. AI-generated content
Parts of the service — including written analysis and summaries — are produced or assisted by automated systems and large language models. AI-generated content may contain errors or omissions and should not be relied upon as fact or advice. Always apply your own judgement.
6. Acceptable use
You agree not to misuse the service: no unlawful activity, no attempts to disrupt or reverse-engineer the platform, no automated bulk access outside permitted API limits, and no use that infringes the rights of others.
7. No guaranteed outcomes & assumption of risk
MetricKick does not guarantee any result, profit, win rate, return on investment, or betting outcome, and nothing in the service should be read as such a guarantee. Model probabilities, fair odds, expected-value figures, confidence scores, "banker" or high-confidence selections, and accuracy or performance statistics are estimates and descriptions of past or modelled behaviour only; they do not predict the future and may not be repeated.
You acknowledge that betting and gambling carry an inherent and substantial risk of financial loss, that you may lose some or all of any money you stake, and that you alone decide whether, how, and how much to bet. You accept all of that risk. Any decision you make using the service is made on your own independent judgement and at your sole risk.
8. Limitation of liability
To the maximum extent permitted by applicable law, MetricKick and its owners, operators, employees, and suppliers provide the service "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.
To the maximum extent permitted by applicable law, we will not be liable to you or any third party for any betting or gambling losses, lost profits, lost opportunities, loss of data, or any indirect, incidental, special, consequential, punitive, or exemplary damages arising out of or relating to your use of (or inability to use) the service, even if we have been advised of the possibility of such damages, and regardless of the legal theory on which the claim is based.
Where liability cannot lawfully be excluded, our total aggregate liability to you for all claims arising out of or relating to the service is limited to the greater of (a) the total amount you paid us in the 12 months before the event giving rise to the claim, or (b) USD 100. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law (such as liability for death or personal injury caused by negligence, or for fraud).
Some jurisdictions do not allow certain exclusions or limitations of liability, so some of the above may not apply to you; in that case our liability is limited to the smallest extent permitted by law.
9. Indemnification
You agree to indemnify and hold harmless MetricKick and its owners, operators, and suppliers from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or connected to your use of the service, your bets or gambling activity, your breach of these Terms, or your violation of any law or the rights of any third party.
10. Governing law & disputes
These Terms and any dispute arising out of or relating to them or the service are governed by the laws of the jurisdiction in which the operator of MetricKick is established, without regard to conflict-of-laws rules, and subject to any mandatory consumer-protection rights you have in your country of residence.
Before bringing any formal claim, you agree to first contact us at support@metrickick.com so we can try to resolve the matter informally. Nothing here removes any non-waivable right you have to bring proceedings in your local courts where applicable law gives you that right.
11. Acceptance & changes to these Terms
By ticking the consent box at sign-up, creating an account, or otherwise using MetricKick, you enter into a binding agreement on these Terms. We record each acceptance — including the version accepted and the date and time — as proof of your agreement.
We may update these Terms from time to time. When we make material changes we will update the version and "last updated" date and ask you to review and accept the new version the next time you use your account. If you do not accept the updated Terms, you must stop using the service. Continued use after an update means you accept it.
